São várias as novidades no mercado de trabalho. Além da reforma trabalhista, outras mudanças também ocorreram na relação entre colaborador e empresa.

Uma mudança que promete fazer a diferença e estimular a contratação de profissionais mais jovens é o modelo de Contrato de Trabalho Verde e Amarelo. Lançado em 2019, o novo modelo começa a ser aplicado agora, em 2020.

O que é o Contrato de Trabalho Verde e Amarelo?

O Contrato de Trabalho Verde e Amarelo surgiu da ideia de estimular o registro do primeiro emprego para jovens, com faixa etária entre 18 e 29 anos.

A proposta desse novo modelo de trabalho é estimular a contratação e a criação de novos postos para esses jovens. Assim, permite-se que eles comecem a vida profissional em condições especiais para construírem suas carreiras e garantirem o registro do primeiro emprego na carteira de trabalho.

A MP que definiu o Contrato de Trabalho Verde e Amarelo certifica de que essa modalidade pode ser aplicada em qualquer tipo de atividade, seja ela transitória ou permanente.

Para quem esse novo modelo de contrato se aplica?

O Contrato de Trabalho Verde e Amarelo é válido para jovens de 18 a 29 anos que estão entrando no mercado de trabalho para seu primeiro emprego.

É importante lembrar que, para essa MP, não são considerados como primeiro emprego: contratos de experiência, menor aprendiz, trabalhos intermitentes e trabalhos avulsos.

Caso o trabalhador tenha sido contratado em uma das categorias previamente citadas, é preciso que a empresa aguarde 180 dias para poder contratá-lo no regime do Contrato de Trabalho Verde e Amarelo.

Essa exceção está prevista no art. 2:

§ 4º O trabalhador contratado por outras formas de contrato de trabalho, uma vez dispensado, não poderá ser recontratado pelo mesmo empregador, na modalidade Contrato de Trabalho Verde e Amarelo, pelo prazo de cento e oitenta dias, contado da data de dispensa, ressalvado o disposto no parágrafo único do art. 1º.

Quais são os direitos trabalhistas?

O Contrato de Trabalho Verde e Amarelo possui algumas diferenças se comparado ao contrato de trabalho convencional.

A primeira grande diferença é que, de acordo com o acordado entre contratado e contratante, o trabalhador poderá receber imediatamente o pagamento das parcelas:

  • Salário-base;
  • férias proporcionais com o tradicional acréscimo um terço constitucional;
  • décimo terceiro proporcional;
  • FGTS calculado sobre a remuneração de 2%.

Isso significa que, se o colaborador e o contratante combinarem que esses valores serão pagos mensalmente, ao final de cada mês o funcionário poderá contar com essas quantias.

Em caso de hora extra, a remuneração é acrescida de, pelo menos, 50% do valor da hora normal.

A liberdade de negociação entre as duas partes também é uma característica do novo modelo de contrato. Por isso, o banco de horas ou regime de compensação de horas extra pode ser feito através de acordo individual.

Quais são as vantagens para as empresas?

Para as empresas, o Contrato de Trabalho Verde e Amarelo é uma excelente alternativa porque traz diversos benefícios. São eles:

  • salário-educação;
  • redução da alíquota do FGTS, que cai de 8% para 2%;
  • contribuição previdenciária patronal;
  • contribuições sociais feitas ao Sistema S;
  • redução de 50% da multa sobre o saldo do FGTS, caso as partes acordem em antecipar mensalmente.

Para empresários que têm interesse nessa modalidade, ela já é uma oportunidade. Para a contratação de empregados de acordo com o Contrato de Trabalho Verde e Amarelo, as empresas têm do dia 1° de janeiro de 2020 até 31 de dezembro de 2022.

O Contrato de Trabalho Verde e Amarelo oferece vantagens para empresários e profissionais. Além do estímulo à contratação de jovens, garante que a empresa consiga ter algumas economias em taxas e impostos no dia a dia.
